I don't see "lewd" as having anything to do with it. The law says that commercial interests can't put up roadside advertisement without a permit.
Playboy is trying to get around this by saying that their logo is "art". If this is is true, then Nike, Ford, Kellogg's, Chrysler, and a whole lot of others could make the same claim.
