WEST PALM BEACH, Fla. - Rush Limbaugh could see a deal with prosecutors in a long-running prescription fraud case collapse after authorities found a bottle of Viagra in his bag at Palm Beach International Airport. The prescription was not in his name.


Limbaugh was detained for more than three hours Monday at the airport after returning from a vacation in the Dominican Republic. Customs officials found the Viagra in his luggage but his name was not on the prescription, said Paul Miller, a spokesman for the Palm Beach County Sheriff's Office.

Miller said the alleged violation could be a second-degree misdemeanor. The sheriff's office was investigating and will soon turn the case over to the state attorney's office, which had no immediate comment Tuesday.

Under the deal reached last month with prosecutors, Limbaugh was not to be arrested for any infraction for 18 months in exchange for authorities deferring a charge of "doctor shopping." Prosecutors had alleged the conservative talk-show host illegally deceived multiple physicians to receive overlapping painkiller prescriptions.

Limbaugh also must submit to random drug tests and continue treatment for his admitted addiction to painkillers.

Limbaugh's doctor had prescribed the Viagra, but it was "labeled as being issued to the physician rather than Mr. Limbaugh for privacy purposes," Roy Black, Limbaugh's attorney, said in a statement.

U.S. Customs and Border Protection examined the 55-year-old radio commentator's luggage after his private plane landed at the airport, Miller said.

Investigators confiscated the drugs, which treat erectile dysfunction. Limbaugh was released without being charged.

Not to defend the "criminal actions" described here but.... celebs often have to do things using a pseudonym (sp?) due to privacy issues. There are too many opportunities for the public to learn about what prescriptions an actor, musician, politician, member of the media may have if they are always processed under their own name. The doctor should have just given Rush some sample packs for travel use. There's a good chance that his attorney is telling the truth.

sounds believeable, but when you're in the spotlight, you should take extra precautions, especially when there are so many people wanting to publicly embarrass you

Apparently you didn't get the memo from the federal government. The 'war on terror' repealed large parts of the U.S. Constitution, including the right to privacy as outlined in the Fourth Amendment, even for celebrities.

I don't agree with it as I am one of the growing numbers who think 9/11 was an "inside job" basically orchestrated by Cheney, but Limbaugh has been cheering it on ever since then.

He's being bitten on the ass by the very same laws, rules and regulations he advocated. They've already told us the "war" will last forever and thus he will never get his right to privacy back.

I think at last report it was something like 80 million Americans of voting age wanted the investigation into what actually happened on 9/11 to be reopened.

But it never will be. There are too many gullible citizens like you and the country is basically destroyed, and it won't be coming back. Because people like you don't want it back.

You will allow the war profiteers to spend you and future generations into debt slavery, all the while waving the flag and thinking you are doing God's service.

I'm not that young anymore. I really feel sorry for the kids in high school, though. They are going to find it more and more difficult just to survive.

It's always worse than you think. If you spent even half as much time reading up on 9/11 as you probably do on high school football, you might have a different viewpoint and not just ridicule and call "hater' those who have a contrary viewpoint based on many hours of research.

It's not liberal to think your own government capable of great evil. Liberals love and trust government. What gets me is that conservatives now do, too, as long as their icon is in office.

I believe in the Jeffersonian principle "that government is best which governs least."

Limbaugh used to say he believed that, too. But he hasn't in a long time and, as I repeat, it's come back to bite him in the ass.
