I would say with the yellow markings under the head that its a Water Moccasin also know as a Cottonmouth.

Poke it a little with your foot and get it to open its mouth.

Like I said a copper mouth water snake.

Its a moccasin. They generally dont like the fast moving water. They like back water areas.

You meant it is a copperbacked rattle mocassin! Bang Bang Bang! Check for fangs after it quits moving.

Good thing he didn't see a rattlesnake in his garden and have it identified as a garden snake!

After reading this, I'm inclined to say watersnake based on the shape of the head.

Nope classic Water Moc. Coloration, yellow on the lower jaw. If he opened his mouth it would be white.

If I'd kept looking on the 'net, I would've come across this and agreed............him done be a Cottonpickin Cottonmouth:

http://www.dausettrails.com/cottonvswater.htm

It was the part about cocking the head at 45 degrees on land.

Anyways, CAM you needs to stay away from that critter!!!
