As many of you know, KSTV's web stream on our web site and what feeds several different apps. (Tune in Radio , etc.) is currently off line. Believe it or not, the government shut down is affecting this.

Our corporate offices received a call on Thursday of last week from a licensing company representing song writers. We were told since we don't have a license with their group, we could not stream our station. Our defense was that we don't need their license because in the football games, we don't play songs. Through further discussions, the question was asked if we used a crowd microphone during our broadcast. We answered that we did and were then told that we are in violation because any song the band plays in the background has licensing rights and our web stream doesn't have license to play them. I thought this was completely idiotic but later found out that it is true. Isn't this country great. Someone writes a song and because during a high school football broadcast it is possible to hear the band off in the distance playing that song, they should receive music royalties from a web stream.

Once this situation was discovered, our response was okay, we'll register with this licensing company and pay whatever yearly fee is involved to stay in compliance. Here is where the government comes is. Part of the registration process involves filing with a government agency involved with copyright. Since the government is shut down, we can't make application. Therefore, we will not have a KSTV stream of the football games until this application can be completed and accepted. We are told the acceptance process takes about two weeks. Therefore, if Uncle Sam opens back up for business this week, we might have our stream back up for the final regular season game. If the gov't stays shut down for a few more weeks, this will affect the playoffs.

The fine for ignoring these folks and doing what we want, starts at $50,000!

I'm sure the artist that will receive probably receive less than 1% of this fee really care too.
