Uh-oh, Blackmon better come up with some receipts for those tickets or Dez Bryant might of got OSU in a pickle. Not that Dez has ever had any NCAA infraction history:doh:

I never said he was... he is under the age of 21 and had alcohol on his breath.. that is AGAINST THE LAW.. that was my whole point.
from the article.."There were field sobriety tests given on the side of the road,” said Dustin Bartram, the public information officer for the Carrollton Police Department. “The officer determined that there was a detectable amount (of alcohol) on (Blackmon).”

It said he had alcohol on his breath, and he is a minor.

Isn't speeding above 25 mph considered a Class A misdemeanor in the state of Texas? Punishable by jail and a fine of up to $2,500

Very stupid to be going 92 through 'town', still the Carrollton officer was a pr!ck for giving him a DUI after passing the field sobriety tests... he obviously wasn't under the influence. A 'detectable' amount... measured how? Smell, behavior, color of the eyes?
The man is going to be 21 in less than 3 months, at a Cowboys game with his buds, has a beer or two, apparently not too many and gets busted...
FACT: The US is the ONLY country on the planet (other than some Islamic countries) where you have to be 21 to drink a beer. Treat them like kids until they're 21 and they'll act like it...just sayin.

As a minor you can pass every sobriety test imaginable, it does not matter. As a minor you don't have to be drunk to be arrested and/or charged with a DUI. All it takes is one drop, or in this case "a detectable amount".

A fact I wasn't aware, I guess it was detected via a breathalyzer, I hadn't considered that when I posted before...

Even so isn't a DUI under .08 and it becomes a DWI once you pass over that limit?

Yes. If I'm not mistaken, he received a DUI. Which I'm assuming, even though he didn't take a breathalyzer, was given to him because he is a minor and any detectable amount is a DUI if you're underage.
